1 Introduction

All other terms and policies displayed on the Site—including our Privacy Policy and Ticketing Disclaimers—are hereby expressly incorporated by reference. We reserve the right to modify these Terms from time to time. Changes will be noted by the “Last updated” date at the top of this page, and use of the Site after such changes will be deemed acceptance of all revisions. You should frequently review these Terms.

Users who are subject to industry-specific regulations (e.g., HIPAA or FISMA) should not use the Site. Use in contravention of the Gramm-Leach-Bliley Act is prohibited. Usage is restricted to persons over 13 years of age. Users under the age of majority in their jurisdiction must have parental or legal guardian consent.

2 Ownership and Intellectual Property

Except as otherwise indicated, all Content—such as code, software, databases, graphics, text, icons, and media on the Site (“Content”) and all trademarks, service marks, and logos (“Marks”)—are owned or licensed by us and protected under United States and international intellectual property laws.

You are permitted a limited personal, non-commercial license to use and access the Site and its booking features. All rights not otherwise granted are strictly reserved. “Amtrak” is a registered trademark of the National Railroad Passenger Corporation. TrainZConnect is an independent agency and claims no ownership of third-party marks.

3 User Obligations

By accessing the Site or requesting train ticket reservations, you acknowledge and warrant that:

• You will input accurate, current, and complete registration and passenger information;
• You possess legal capacity to enter into binding agreements and comply with these Terms;
• You are not a minor under the age of 13;
• You will not access the Site using automated bots, scrapers, or other non-human tools;
• You will not utilize the Site or ticketing services for any illegal or unauthorized purpose.

4 Prohibited Conduct

You are not allowed to use the Site for unauthorized purposes, including but not limited to:

• Mining, scraping, or harvesting data or rail schedules without express written permission;
• Misleading, defrauding, or deceiving other travelers or agency personnel;
• Circumventing, disabling, or interfering with security-related features of the Site;
• Using the Site or booking telephone lines to harass, abuse, or harm others;
• Uploading viruses, Trojan horses, malicious software, or impersonating any individual or business entity.

5 License of Contributions

We may view and use your submitted reviews, inquiries, or feedback according to our Privacy Policy and Site settings. We claim no ownership of your original contributions, but we may utilize your suggestions, comments, and ideas freely for service enhancements without compensation or attribution.

6 Termination

These Terms remain in full force and effect while you use the Site or engage our booking services. We maintain the sole right to suspend, terminate, or deny access to the Site or telephone concierge to any individual at any time, for any reason or no reason, without prior notice or liability.

7 Governing Law

These Terms and your use of the Site are governed by and construed in accordance with the laws of the State of Florida, without regard to conflict-of-law principles.

8 Dispute Resolution

The parties agree to attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms or our services informally for at least 120 days before initiating arbitration.

Any unresolved dispute will be settled through binding individual arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules in the State of Florida. You expressly waive any right to participate in a class-action lawsuit or trial by jury.

9 Disclaimer & Limitation of Liability

The Site and all booking assistance are provided on an “as-is” and “as-available” basis without warranties of any kind, whether express or implied. Train schedules, route itineraries, tariffs, sleeper roomette availability, and rail conditions are determined by third-party passenger rail operators and are subject to change.

To the fullest extent permitted by law, TrainZConnect and its agents shall not be liable for any indirect, consequential, incidental, punitive, or special damages. Our aggregate liability to you for any cause whatsoever shall at all times be limited to the service fee amount paid by you to our agency.
